1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and Apex Roofing North Devon LTD ("we", "our", "us"), Company Number 12356835. By engaging our services or using our website, you agree to be bound by these Terms.
2. Our Services
Apex Roofing North Devon LTD provides professional roofing services including but not limited to:
- Full roofing service
- Slating & Tiling
- Pitched Roofing
- Leadwork
- EPDM rubber roofing
- Garage Roofing
- Velux and Skylights installation
- Roofing Repairs
- Chimney Work
- Site work & New Builds
- Surveys & Inspections
- Skylight Windows
Services are provided within a 40-mile radius of Barnstaple, North Devon.
3. Quotations and Pricing
- Quotations: All quotations are valid for 30 days from the date of issue unless otherwise stated
- Pricing: Prices quoted are based on the scope of work discussed and may change if additional work is required
- VAT: All prices are subject to VAT at the current rate where applicable
- Additional Work: Any additional work not included in the original quotation will be charged separately with your prior agreement
4. Payment Terms
- Deposits: A deposit may be required before work commences, typically 25% of the total quote
- Payment Schedule: Payment terms will be agreed upon acceptance of quotation
- Final Payment: Balance is due upon completion of work unless otherwise agreed
- Late Payment: We reserve the right to charge interest on overdue accounts at 4% above the Bank of England base rate
- Methods: We accept bank transfer, cheque, and cash payments
5. Work Commencement and Completion
- Start Dates: Are approximate and subject to weather conditions and material availability
- Weather Delays: Work may be postponed due to adverse weather conditions for safety reasons
- Access: You must provide safe and adequate access to the work area
- Completion: We will make reasonable efforts to complete work within agreed timeframes
6. Customer Responsibilities
You agree to:
- Provide accurate information about your property and requirements
- Obtain any necessary planning permissions or building regulations approval
- Ensure the property is accessible on agreed work dates
- Remove or protect valuable items near the work area
- Inform us of any hazards, including asbestos or structural issues
- Ensure pets and children are kept away from work areas
- Provide access to electricity and water supply where required
7. Health and Safety
- We comply with all relevant health and safety regulations
- Our team is fully trained and insured
- We will implement appropriate safety measures during work
- Work areas may be cordoned off for safety - please respect these boundaries
- We maintain public liability insurance for your protection
8. Materials and Workmanship
- Quality: All materials used meet British Standards where applicable
- Sourcing: We source materials from reputable suppliers
- Substitutions: If specified materials are unavailable, we will discuss alternatives with you
- Waste: We will dispose of old roofing materials responsibly unless you request otherwise
9. Warranties and Guarantees
- Workmanship Guarantee: We provide a 10-year guarantee on our workmanship for new roofs
- Repair Guarantee: Repair work is guaranteed for 12 months
- Manufacturer Warranties: Materials come with manufacturer warranties which we will pass on to you
- Exclusions: Guarantees do not cover damage from storms, impact, or lack of maintenance
- Claims: Warranty claims must be made in writing within the guarantee period
10. Cancellation Policy
- By Customer: You may cancel up to 48 hours before scheduled work start without penalty
- Deposits: Cancellations after materials have been ordered may result in deposit retention to cover costs
- By Us: We reserve the right to cancel if the work site is unsafe or if payment terms are not met
11. Liability and Insurance
- We maintain comprehensive public liability insurance of £2 million
- We are not liable for pre-existing defects or damage
- Our liability is limited to the value of the work undertaken
- We are not responsible for delays due to circumstances beyond our control
- We will make good any damage caused by our negligence
12. Complaints Procedure

- If required, we will arrange a site visit to assess the issue
- We aim to resolve all complaints within 14 days
13. Intellectual Property
All designs, specifications, and documents we provide remain our intellectual property unless full payment has been received. You may not use our proposals to obtain quotes from other contractors.
14. Variations and Changes
Any changes to the agreed work scope must be confirmed in writing. Additional charges may apply for variations requested after work has commenced.
15. Force Majeure
We shall not be liable for any delay or failure to perform our obligations if such delay or failure results from circumstances beyond our reasonable control, including but not limited to extreme weather, pandemic, government restrictions, or material shortages.
16. Data Protection
We handle your personal information in accordance with our Privacy Policy and UK data protection laws. Your data will only be used for purposes related to providing our services.
17. Dispute Resolution
Any disputes arising from these Terms shall be:
- First addressed through our complaints procedure
- If unresolved, subject to mediation
- Finally determined by the courts of England and Wales
18. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
19. Entire Agreement
These Terms, together with any written quotation and specifications, constitute the entire agreement between us and supersede any prior agreements or understandings.
20. Changes to Terms
We reserve the right to update these Terms at any time. Changes will apply to new contracts entered into after the revision date.
